While it will not prevent an arrest for DUI, you are limiting the amount of evidence for the prosecution if you refuse to consent to a PBT. At the police station, you will have a choice to take the official breath test machine. You have a right to refuse. Should you refuse, it will have a negative impact on your driver's license. If you were tested with a breath test, we can investigate whether the test was properly administered and the machine was properly calibrated. If you were tested by blood test, we may inquire into the qualifications of the person who withdrew or tested the blood sample.
